A shocking development in the Namibian legal system has sparked controversy and left many questioning the integrity of the justice system. The potential testimony of fugitive lawyer Marén de Klerk via video link has become a hot topic, with implications for the Fishrot fraud case and the nation's fishing industry.
The Fishrot scandal, as it's known, revolves around alleged corrupt practices within the National Fishing Corporation of Namibia (Fishcor). This case has sent shockwaves through the country, with accusations of massive-scale corruption and fraud.
But here's where it gets controversial: de Klerk, who is wanted in Namibia for his alleged involvement in the Fishrot case, may now testify remotely. This decision was made after the Supreme Court overturned a previous ruling, allowing de Klerk to appear via video link.
Acting judge of appeal Dave Smuts highlighted the gravity of the situation, stating that de Klerk's testimony "relates to an alleged corrupt scheme involving potential criminality on a massive scale in the context of the Namibian economy." Smuts further emphasized the public's interest in addressing corruption, as it undermines the rule of law and accountability principles enshrined in the Constitution.
Fishcor, a state-owned fishing company, is suing African Selection Fishing (Namibia) and Seaflower Pelagic Processing. They claim that agreements made with former minister Bernhard Esau and African Selection Fishing were corrupt and not in good faith. Fishcor wants these agreements declared null and void.
The agreements in question involve the allocation of an annual horse mackerel quota of 50,000 tonnes to Fishcor for 15 years. Fishcor and African Selection Fishing also entered into a partnership, becoming shareholding partners in Seaflower Pelagic Processing, with Fishcor making its quota available to Seaflower for 30 years.
Fishcor alleges that these agreements were part of a corrupt scheme, central to what is now known as the Fishrot scandal. They estimate that the unlawful appropriation of revenue from the Namibian fishing industry could amount to around N$2 billion.
De Klerk's involvement is crucial, as he was intimately connected to the advice and input about these agreements. He has provided a sworn statement to the Anti-Corruption Commission, naming key players in the scandal, including former attorney general Sacky Shanghala, Esau, and James Hatuikulipi, the former Fishcor board chairperson.
According to de Klerk's affidavit, Shanghala asked him to attend a meeting with Adriaan Louw, the board chairperson of African Selection Fishing and Seaflower Pelagic Processing, near the end of December 2016. During this meeting, Shanghala allegedly stated that he could approve a proposed joint venture between Fishcor and Seaflower, and that discussions had already taken place between Esau and Louw.
Louw, however, denies all allegations and the existence of a corrupt environment. He argues that de Klerk's status as a fugitive from justice in Namibia should prevent him from testifying remotely.
But here's the part most people miss: de Klerk's fear for his life and the public interest in uncovering potential massive-scale corruption. Acting judge Smuts acknowledged de Klerk's reasonable fear and the importance of his testimony. Smuts and two other judges agreed that allowing de Klerk to testify via video link would not bring the administration of justice into disrepute.
